A patio can be built up to 500mm to the neighbouring boundary line with their consent. You may be able to have the posts situated on the boundary, but the patio roof needs to be setback. Regulations vary between council’s.
Council requires all owners affected to sign a consent form and some Council’s even require a Site Plan and Elevation Drawing to be sighted and signed by your neighbours.
If you do not know who the owners are or are not on speaking terms, there are a couple of other options but please be aware this can make the Shire Approval process longer.
• We can request your local Council to post a generic letter which gives the neighbour 14 days to respond with their approval
• You can send a consent form via Registered Post and we will send a copy of the receipt to your Council with the application. The neighbour has 14 days to respond with their approval
Your neighbour won’t give you signed approval for the proposed patio? Don’t stress! The Council will generally still approve the application given it is within Council regulations
